Not every consent order is straightforward. Our solicitors regularly handle three areas that require particular care and technical skill:

Clause drafting

A consent order is only as strong as the wording behind it. Our solicitors draft each clause to reflect exactly what has been agreed, reduce the risk of the court querying or rejecting the order, and close down the possibility of future financial claims where a clean break is intended.

Pension sharing

Pensions are frequently the most valuable, and most overlooked, asset in a divorce. We regularly draft pension sharing annexes and liaise with pension providers to make sure a pension sharing order is technically correct and capable of being implemented, not just agreed in principle.

Post-order distribution

Getting the order approved by the court is not the end of the process. We help clients understand and manage what happens next, including transferring property, dividing savings and investments, and implementing pension sharing, so the agreement is actually carried through rather than left on paper.

How our consent order service works

  1. Tell us your agreement. You and your ex-partner confirm how you’ve agreed to divide your finances.
  2. We draft the order. Your solicitor prepares a court-ready consent order and the supporting Statement of Information (Form D81).
  3. You review and sign. We explain the wording in plain English before anything is submitted.
  4. We submit to court. Your application is filed with the Family Court on your behalf.
  5. The judge approves. Once approved, your agreement becomes a legally binding court order.
  6. We help with implementation. Including pension sharing and post-order distribution where relevant.
