This was made clear in the landmark Supreme Court case Radmacher v Granatino [2010], which confirmed that courts should give “decisive weight” to a prenuptial agreement provided it is entered into freely, with full understanding, and does not prejudice the needs of any children.

That means a prenup that’s well-drafted and meets legal standards is likely to be upheld by the court during a divorce.
